THE UNITED STATES MAKES A PRELIMINARY ANTI-DUMPING RULING ON DIFLUOROMETHANE (R32)!

On August 21, 2020, the U.S. Department of Commerce announced a preliminary anti-dumping ruling on imports of difluoromethane (R32) from China. The preliminary ruling was that the dumping rate of companies that received a separate tax rate was 196.19% and the dumping rate of other Chinese manufacturers/exporters. It is 221.06%. The US Department of Commerce is expected to make a final anti-dumping ruling on this case on November 3, 2020. This case involves products under the U.S. coordinated tariff number 2903.39.2035.


On February 13, 2020, in response to an application submitted by the American company Arkema Inc. on January 23, 2020, the U.S. Department of Commerce announced an anti-dumping investigation on difluoromethane imported from China. On March 5, 2020, the U.S. International Trade Commission (ITC) voted to make an affirmative preliminary ruling of anti-dumping industrial damage on difluoromethane imported from China. According to estimates by the U.S. applicant, the U.S. imported about 21.5 million U.S. dollars from China in 2018.


According to the Ministry of Commerce, on August 19, the Argentine Ministry of Production and Development issued Resolution No. 422 of 2020, making a final anti-dumping ruling on HFC mixed refrigerants originating in China, and against tetrafluoroethane and pentafluoroethane. An anti-dumping duty of 7% of the FOB price is imposed on refrigerants, and an anti-dumping duty of 23% of the FOB price is imposed on refrigerants containing difluoromethane and pentafluoroethane, valid for 5 years.
